Access to BrightSpark Education's products and services is limited to subscribers and/or, in the case of parents and schools, their nominated students.

The trade mark, copyright and content of this site (including, but not limited to, text, graphics and software) are owned by BrightSpark Education and are protected by English and international intellectual property laws. You are not permitted to reproduce them in any format without BrightSpark Education's prior written permission. You may not download, store, copy, distribute, transmit, re-transmit, modify, show in public, print hard copies of or photocopy any part of this site without BrightSpark Education?s prior written consent.
BrightSpark Education is committed to ensuring that all material and content on this site and the provision of tutorials provide a valuable educational tool for students and their parents, teachers and schools. However, no warranty or guarantee is made as to the effectiveness or accuracy of the content or any tutorial. BrightSpark Education accepts no liability for any errors or omissions, or from erroneous conclusions being drawn from the content or the failure of the tutorials to provide the results hoped for.
The use of this site is entirely at your own risk, for which we shall not be liable. It is your responsibility to ensure that any products, services or information available through, or provided by, this website meet your specific requirements.
You must not use this site for fraudulent purposes or in connection with any criminal offence or other unlawful activity.
Site availability
BrightSpark Education works hard to ensure that this site is up and running 24 hours a day, 7 days a week. However, BrightSpark Education cannot guarantee the availability of this site and will not be liable for any reasons for which this site is unavailable at any time for any period.? BrightSpark Education reserves the right to limit access to this site for routine maintenance and site updates and you acknowledge that, at times, this site may not be available due to circumstances outside of BrightSpark Education's control. Access to this site may be suspended temporarily or permanently without notice.
Tutor relationship and availability
BrightSpark Education does not employ any tutors directly, but sources them through trusted, independent third parties. Whilst we endeavour to ensure that all tutors meet our standards as regards competency in the subject and teaching ability, we cannot guarantee, nor do we accept any liability for, the quality of tutor-student interaction.
BrightSpark Education?s systems and tutors are operated with the intention of 24 hour a day, 7 day a week availability, and unlimited tutoring access for students with subscription packages. However, given the nature of unexpected spikes in demand and, at times, the limited nature of human resources, we cannot guarantee this availability, nor do we accept any liability (including, without limitation any refund claims) at times of low or no availability.
Refunds
We are unable to make refunds for any services purchased but not used. It is at the discretion of BrightSpark Education as to whether any refunds will be made for any particular reason.
Payment and Cancellation
Payment is taken at the time the account(s) is/are purchased.
Whilst provision of tutoring credit is unlimited, it can only be guaranteed during the academic year in which it is purchased.
Session cancellation can be made up to 1 hour in advance of a scheduled session and the session will be credited back to the user's account. We cannot make a refund if cancellation is made less than 1 hour before the scheduled session.
Account Usage
BrightSpark Education reserves the right to withdraw accounts without refund for failure to comply with these terms and conditions, or for any actions we deem to be inappropriate, including, but not limited to, abuse of tutors, uploading inappropriate content, accounts being accessed by multiple users or continued failure to attend tutorials.
It is the account holder's responsibility to ensure that their account username and password is stored securely and that account access is not abused.
General
BrightSpark Education will not be liable for any loss or damage (including, without limitation, loss of profit, production, anticipated savings or business opportunities or any type of indirect, special, economic or consequential loss) arising in contract, tort (including negligence) or otherwise from the use of or inability to use this site, or any material contained on it, or from any action or decision taken as a result of using this site or any such material. BrightSpark Education does not exclude or restrict liability for fraudulent misrepresentation or for death or personal injury resulting from its negligence.
BrightSpark Education accepts no responsibility for the content of any website to which a link from this site exists.
Any failure or delay by BrightSpark Education to enforce the provisions of these terms and conditions, at any time and for any period of time, is not a waiver of them or of the right subsequently to enforce any or all provisions of these terms and conditions.
When you visit this site or send e-mails to BrightSpark Education, you are communicating with BrightSpark Education electronically. BrightSpark Education communicates with you by e-mail or by posting notices on this site. For contractual purposes, you consent to receive communications from BrightSpark Education electronically and you agree that all agreements, notices, disclosures and other communications that
BrightSpark Education provides to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
